Terms of Service

1. Who can use NOMMMZ

You must be at least 13 years old to use NOMMMZ. By using the app you confirm that you are 13 or older. NOMMMZ is not directed at children under 13, and we do not knowingly collect personal information from them.

2. What NOMMMZ is

NOMMMZ helps you discover dishes and restaurants matched to your taste. Menu information — including dish names, descriptions, prices, hours, and dietary or allergen tags — is collected from restaurant websites and other sources, and much of it is estimated automatically. It can be incomplete, out of date, or wrong. Restaurants change their menus, prices, hours, ingredients, and kitchens without telling us.

3. Food allergies and dietary needs — read this

ALLERGEN AND DIETARY INFORMATION IN NOMMMZ IS ESTIMATED FROM MENU TEXT AND IS NOT VERIFIED. IT IS NOT MEDICAL ADVICE AND IS NOT A SUBSTITUTE FOR ASKING THE RESTAURANT DIRECTLY. IF YOU HAVE A FOOD ALLERGY, INTOLERANCE, OR DIETARY REQUIREMENT, YOU MUST CONFIRM DIRECTLY WITH THE RESTAURANT BEFORE ORDERING — EVERY TIME.

Filters that hide dishes containing your allergens work on the same estimated data: dishes that remain visible are not guaranteed to be free of any allergen, and hidden dishes are hidden based on estimates. You accept full responsibility for confirming that any food or drink is safe for you before consuming it.

4. Menu, price, and availability accuracy

Dishes, prices, hours, promotions, and availability shown in NOMMMZ may have changed since we collected them. We make no promise that anything shown in the app is currently offered, at the price shown, or prepared as described.

5. Your content

You can add photos, ratings, and notes ("your content"). You keep ownership of your content. By posting it, you grant NOMMMZ a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt (for example, resizing or compressing), and display your content in the app and in NOMMMZ marketing. This license ends when you delete the content or your account, except where the content has already been shared with others in the app or is retained briefly in backups.

You promise that your content is yours — for photos, that you took them — and that it does not infringe anyone else's rights. Do not post content that is unlawful, harassing, hateful, sexually explicit, or unrelated to food and restaurants. We may remove content or restrict accounts that break these rules.

6. Copyright complaints

If you believe content in NOMMMZ infringes your copyright, email support@nommmz.com with: (1) the content and where it appears, (2) your contact information, (3) a statement that you believe in good faith the use is unauthorized, and (4) a statement, under penalty of perjury, that you are the owner or authorized to act for the owner. We respond to valid notices under the Digital Millennium Copyright Act, including removing content and, for repeat infringers, terminating accounts.

Restaurant owners: if your menu or other business information appears in NOMMMZ and you want it corrected or removed, contact us at the same address — we honor verified owner requests within 48 hours, and you can also claim your listing in the app to control it directly.

7. Restaurant owners and promotions

Restaurant owners can claim their listing, edit their information, and offer promotions. When you claim a listing you promise you are authorized to represent that business, and any photo or content you upload is owned by or licensed to the business, with a license to NOMMMZ to display it. You agree to indemnify NOMMMZ against claims arising from content you upload.

Promotions shown in NOMMMZ are offered by the restaurant, not by NOMMMZ. The restaurant is solely responsible for honoring a promotion, and availability and terms are at the restaurant's discretion. NOMMMZ is not a party to any transaction between you and a restaurant.

8. Acceptable use

Do not misuse NOMMMZ: no scraping or bulk-extracting our data, no reverse engineering, no impersonating others or businesses you do not represent, no spamming, no interfering with the service, and no using the app to break the law. We may suspend or terminate accounts that violate these Terms.

9. Disclaimer of warranties

NOMMMZ IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THE ACCURACY OF ANY MENU, PRICE, HOURS, DIETARY, OR ALLERGEN INFORMATION.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOMMMZ LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY INJURY, ILLNESS, ALLERGIC REACTION, OR OTHER HARM ARISING FROM FOOD OR DRINK YOU CHOOSE TO CONSUME, OR FROM RELIANCE ON INFORMATION IN THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

11. Governing law and disputes

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Clark County, Nevada, and you consent to their jurisdiction.

12. Changes and contact

We may update these Terms as the service evolves. If a change is material we will notify you in the app before it takes effect; continuing to use NOMMMZ after that means you accept the updated Terms.
